Spin Master has filed a civil lawsuit against Brix n Clix, Rehco and CYI in the U.S. District Court for the Central District of California to stop the manufacture and sale of Starfly toys, which Spin Master claims infringe on the rights of its Flutterbye Flying Fairy toy.
The lawsuit claims that that marketing and sale of Starfly toys was a “calculated attempt” by the defendants to illegally capitalize on the success of Spin Master’s popular Flutterbye Flying Fairy toy. In addition to copyright infringement, the lawsuit includes claims of false designation of origin, trade dress infringement and unfair competition and seeks damages and other forms of relief.
